By accessing or using ObservAll, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the service.
2. Use License
ObservAll grants you a personal, non-transferable, non-exclusive license to use the service for your personal or professional use, subject to these terms.
- You must not use the service for any illegal or unauthorized purpose.
- You must not attempt to decompile or reverse engineer any software contained in ObservAll.
- You must not use the service to propagate malware or perform malicious activities.
- You agree to comply with all third-party terms of service for content accessed through our platform, including the YouTube Terms of Service.
3. AI-Generated Content Disclaimer
ObservAll uses Artificial Intelligence to generate intelligence digests and summaries. You acknowledge and agree that:
- AI-generated content may be inaccurate, incomplete, or outdated.
- The digests are provided for informational purposes only and do not constitute professional advice.
- We are not responsible for any decisions made based on the AI-generated content provided by the service.
4. Content Analysis & Fair Use
ObservAll is a transformative intelligence tool. When you provide links to third-party content (such as YouTube videos):
- Transformative Use: You acknowledge that our service creates text-based summaries and analysis ("Digests") which are transformative in nature and intended for personal educational or professional research purposes.
- Non-Substitution: Digests are not intended to serve as a substitute for original content. We encourage users to visit the original source to support creators.
- User Responsibility: You are solely responsible for ensuring that your use of the service for specific content complies with applicable copyright laws and Fair Use doctrines in your jurisdiction.
5. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
6. Prohibited Activities
In addition to other restrictions, you agree not to:
- Use the service to scrape, download, or store substantial portions of third-party media in violation of their respective Terms of Service.
- Redistribute raw audio or video files retrieved by the service.
- Use our AI digests to create competing content products that substitute for the original source.
7. Service Availability & Third-Party Access
Our ability to provide the service depends on continued access to third-party platforms (such as YouTube, Google, and OpenRouter).
- We are not liable if a third-party platform blocks or restricts our access to their content, which may render parts of our service unavailable.
- Service availability is subject to the continued stability and API terms of these third-party providers.
8. Content and Third-Party Links
ObservAll processes content from third-party feeds and utilizes external service providers for AI processing (such as Google or OpenRouter) and email delivery (Brevo.com). We are not responsible for the accuracy, legality, or reliability of any content generated from these external sources or the availability of these third-party services.
9. Limitation of Liability
In no event shall ObservAll be liable for any damages arising out of the use or inability to use the service, even if we have been notified of the possibility of such damages.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ObservAll operates, without regard to its conflict of law provisions.
